Acceptable Use & Community Guidelines
The short version. Nyvo connects communities of newcomers. To keep that safe and useful, there are some things you can't do here: anything illegal, child sexual exploitation material, threats, doxing, hate speech, sexual content, spam, scams, impersonation, IP infringement and evading bans. We screen images and text automatically and act fast on reports — typically within 24 hours for safety reports and 48 hours for everything else. Three substantiated reports against you trigger a 7‑day automatic suspension. You can appeal anything.
This Acceptable Use & Community Guidelines document (the AUP) is part of the legal Documents that govern your use of the Service. Capitalised terms used here have the meanings in our Definitions. It must be read together with our Terms of Service, Privacy Policy, and (if you list Events) the Organizer Agreement.
1. Why this matters
Nyvo's purpose is to help people who have moved to a new country (and the people who already live there) find each other, share information, find work, find homes and gather at Events. That only works if the Service stays safe, trustworthy and welcoming. This document explains what we expect from you, what we do to enforce it, and how to ask us to do better.
We comply with the Online Safety Act 2021 (Cth), the Australian eSafety Commissioner's Basic Online Safety Expectations, the Privacy Act 1988 (Cth), and the position the High Court took in Fairfax Media Publications Pty Ltd v Voller (2021) — platforms can be publishers of content posted by users. To stay on the right side of all of that (and the LGPD for our Brazilian Users), we take Content moderation seriously and we are explicit about how we do it.
2. Things you must not do
You must not, and must not encourage anyone else to, do any of the following on or through the Service.
2.1 Illegal Content and serious harm
- Post or share Content that is unlawful under Australian law, or under the law that applies where you are located when you post it.
- Post or share child sexual exploitation or abuse material (CSAM). This is a zero‑tolerance category. We remove CSAM immediately on detection or report, preserve evidence as required by law, and refer it to the Australian Centre to Counter Child Exploitation (ACCCE) and the eSafety Commissioner.
- Post Content classified as Class 1 or Class 2 under the National Classification Scheme as those terms are used by the eSafety Commissioner (for example, real violence and threats, instructions for serious crime, terror‑promoting Content).
- Threaten, plan or incite violence against any person or group.
- Promote, glorify or recruit for terrorism or any designated terrorist organisation.
- Promote self‑harm, suicide or eating disorders in a way that risks serious harm.
2.2 Harassment, abuse and protected attributes
- Harass, bully, intimidate or stalk any person.
- Send unwanted sexual contact, sexual extortion ("sextortion") or non‑consensual intimate imagery.
- Engage in doxing — that is, sharing another person's home address, workplace, immigration status, phone, identity documents or other identifying information without their consent in a way likely to expose them to harm.
- Engage in hate speech targeting a protected attribute, including race, ethnicity, national or ethnic origin, immigration status, religion, gender, gender identity, sexual orientation, disability, age, pregnancy, marital or family status, or other characteristic protected under Federal, State or Territory anti‑discrimination law.
2.3 Sexual content and nudity
- Post pornography, nudity, or sexually explicit imagery.
- Solicit sexual services or engage in sexual activity through the Service.
- All uploaded images go through Google Cloud Vision SafeSearch. Images flagged as adult, racy or violent will be deleted automatically and you will be notified.
2.4 Hate, scams and deception
- Impersonate another person, a public figure, a business or Nyvo itself.
- Run multi‑level marketing, pyramid, get‑rich‑quick, Ponzi or other deceptive financial schemes.
- Run phishing, romance scams, advance‑fee fraud, fake‑invoice scams or any other dishonest scheme to obtain money or information from other Users.
- Promote, sell or offer items that are illegal or restricted in Australia (including unregistered firearms, illicit drugs, prescription medicines outside lawful channels, wildlife protected under the EPBC Act 1999 (Cth), and items that infringe sanctions).
- Promote or sell alcohol or other age‑restricted goods to minors.
- Misrepresent the price, nature, quality or fitness of any good or service (a breach of the ACL).
2.5 Privacy of other people
- Post Personal Information about someone else (including immigration documents, government identifiers, financial details, intimate images, medical information) without their clear consent.
- Use the Service or any data on it (including names and profile pictures of Ticket holders at check‑in) to build profiles, lists or audiences for marketing or to enrich third‑party datasets.
2.6 Intellectual property
- Post Content you do not have the rights to (for example, copyrighted photos, music or text; trade marks; designs).
- Use another person's name, brand, logo or likeness in a way that infringes their rights or breaches Australian Consumer Law (including passing off).
2.7 Spam and platform manipulation
- Send unsolicited commercial messages or "blast" promotions through the Service.
- Inflate post engagement (likes, reactions, comments, RSVPs) using fake accounts, bots or coordinated behaviour.
- Use the Service to send unsolicited commercial electronic messages in breach of the Spam Act 2003 (Cth).
2.8 Security, abuse and evasion
- Probe, scan, reverse engineer or test the vulnerability of the Service, or interfere with security features, except under a written disclosure agreement with Nyvo.
- Use the Service to distribute malware or to host phishing pages.
- Create multiple accounts to evade a ban, restriction or report‑based suspension.
- Buy, sell or transfer Nyvo Accounts.
- Use the Service through automated means (scrapers, crawlers, bots) other than feeds and APIs we expressly provide for that purpose.
2.9 Events and Tickets — specific rules
- Do not advertise or sell a Ticket for more than its face value (including the Platform Fee actually paid). See clause 5.5 of the Terms of Service and the State anti‑scalping laws referenced there.
- Do not transfer a Ticket where the Organizer has not permitted transfers.
- Do not share QR codes publicly — once a QR code is presented at the door, the Ticket is treated as used.
- Do not run an Event that breaches venue, alcohol, food safety, occupational health and safety, working‑with‑children, public‑health or anti‑discrimination law.
2.10 Direct messages
Nyvo's private 1:1 messages are Content and every rule in this Policy applies to them. When you use direct messages, you must not:
- harass, bully, threaten, stalk or intimidate the person you are messaging, or send unwanted sexual contact, sexual extortion ("sextortion") or non‑consensual intimate imagery (see 2.2);
- send spam, chain messages, or unsolicited commercial or promotional messages, in breach of the Spam Act 2003 (Cth) (see 2.7);
- use a message request or a new conversation to evade a block, a ban or a report‑based suspension (see 2.8);
- share, solicit or link to CSAM, contact or attempt to groom a minor, or share any other prohibited Content (see 2.1 and 2.3). This is a zero‑tolerance category and applies in private messages exactly as it does on public surfaces.
Blocking and message requests. You can block any User. Blocking stops them from messaging you, removes any follow connection between you, and declines any pending message request from them. A first message from someone you do not already follow arrives in a separate requests area and does not send you a notification until you reply, so a stranger cannot push a message onto you. You can report any individual message to us; reporting a message shares that message and the surrounding conversation with our moderation team so we can review it.
3. Reporting Content or behaviour
3.1 If you see something on Nyvo that breaches this AUP, report it. In each list, post, comment, profile and direct message you'll find a Report option that lets you tell us what's wrong. We accept reports from anyone — you don't have to be the target.
3.2 You can also email reports to hello@nyvo.com.au. For matters involving minors, threats or imminent risk to safety, include "URGENT" in the subject line so we triage it on the fastest path.
3.3 Don't report falsely. Submitting reports that are deliberately false, abusive, or designed to weaponise the moderation system against another User is itself a breach of this AUP and will be dealt with under clause 6.
4. Our moderation commitments
We publish the service levels below so you know what to expect. Where the law (including the Online Safety Act 2021 (Cth) or an eSafety removal notice) requires faster action, we will act within that shorter time.
4.1 Service levels (SLAs)
| Category | Our target response |
|---|---|
| Child safety reports (CSAM, grooming, sextortion of a minor) | We act immediately on detection, 24 hours a day. Preservation and law‑enforcement referral follow our internal child‑safety procedure. |
| Other serious safety reports (threats of violence, doxing, sexual extortion, terror Content, suicide promotion) | Within 24 hours of report receipt. |
| All other Content reports (harassment, hate, scams, IP, spam, misleading listings) | Within 48 hours of report receipt. |
| Appeals against a moderation decision or a report‑triggered suspension | We aim to acknowledge within 48 hours and decide within 7 days. |
| Government, regulator or court notices (including eSafety removal notices) | Within the time required by the notice; we cooperate as required by law. |
These are targets; they are not promises and we may take longer where a matter is unusually complex. We will tell you if a delay is expected.
4.2 Automated moderation
We screen text Content at the point of submission for profanity and certain prohibited patterns. Content that fails the screen is auto‑rejected and the author is notified.
We screen uploaded images using Google Cloud Vision SafeSearch. Images flagged as adult, violent, racy or otherwise unsafe are deleted from storage and the author is notified.
Automated decisions can be wrong. You can appeal any automated removal at hello@nyvo.com.au; a human will review.
4.3 Report‑based auto‑suspension
To respond quickly to coordinated abuse, our system can place an Account on a 7‑day automatic suspension when the volume of substantiated reports against it crosses an internal threshold (currently three substantiated reports in a rolling window). This is a precautionary measure, not a final decision.
If you are auto‑suspended:
- you will be notified by email and in‑app;
- you can appeal at hello@nyvo.com.au;
- a human moderator will review the substantiated reports against you; and
- if the reports were not substantiated on review, your Account will be reinstated and we will adjust the record.
4.4 Human review and graduated enforcement
For non‑automatic cases, our moderation steps are:
- Warning (we tell you what was wrong and ask you to stop);
- Content removal (we delete or hide the specific Content);
- Feature limits (you may temporarily lose the ability to post, comment or list Events);
- Temporary suspension of the Account;
- Permanent ban for serious or repeated breaches.
We move directly to step 4 or 5 where the breach is serious enough to justify it (for example, CSAM, credible threats, doxing).
5. Notice‑and‑takedown for IP and defamation
5.1 Copyright
Australia does not have a single statutory notice‑and‑takedown regime equivalent to the United States DMCA, but we operate an equivalent process voluntarily. If you believe Content on Nyvo infringes your copyright, please send a notice to hello@nyvo.com.au with:
- a description of the work you say has been infringed (or a link to it);
- the URL or identifier of the Content on Nyvo that is the alleged infringement;
- your contact details;
- a statement that you have a good‑faith belief that the use is not authorised; and
- a statement under penalty of perjury that you are the rights holder or authorised to act on their behalf.
We will assess the notice and, where it appears reasonable, remove or restrict the Content while we investigate.
5.2 Trade marks and other IP
For trade mark and other IP complaints, please send equivalent details to hello@nyvo.com.au.
5.3 Defamation
If you believe a post or comment on Nyvo defames you, please send a notice to hello@nyvo.com.au that:
- identifies the specific Content (with URL or identifier);
- explains why you say it is defamatory and what loss it has caused; and
- includes your contact details and any evidence you wish to provide.
We will assess the notice promptly (within 24 hours where it is plainly serious). Where a notice raises a credible claim, we will typically restrict or remove the Content while the matter is being assessed. Acting on a defamation notice does not mean we agree that the Content is defamatory; it is a precautionary step consistent with the "innocent dissemination" defence available to digital intermediaries under Australian defamation law as reformed in 2021.
5.4 Counter‑notices
If your Content is restricted under a copyright or defamation notice, you can submit a counter‑notice to hello@nyvo.com.au. Where appropriate, we will reinstate the Content. We may share counter‑notices with the original complainant.
6. eSafety, regulator and law‑enforcement notices
6.1 We cooperate with the eSafety Commissioner under the Online Safety Act 2021 (Cth), including notices under the cyber‑bullying, image‑based abuse, adult cyber‑abuse and harmful online Content schemes.
6.2 We cooperate with regulators including the OAIC (Privacy Act), the ACCC (consumer law), ASIC (financial services advertising), and State‑based consumer affairs offices.
6.3 We respond to lawful requests from law enforcement consistent with our Privacy Policy and applicable law. Where we can, we will notify the affected User before disclosing information.
7. Appeals
If a moderation decision affects you (your Content was removed, your Account was suspended, a report you filed was dismissed), you can appeal:
- by emailing hello@nyvo.com.au with the subject line "Appeal" and a description of the decision you want reviewed;
- within 30 days of the decision.
We aim to acknowledge appeals within 48 hours and decide within 7 days. If new information emerges later, you can ask us to look again.
8. Changes to this AUP
We may update this AUP from time to time as the Service, the law or the abuse landscape changes. For material changes we will give at least 30 days' notice through the Service.
