Definitions

These defined terms are used across our Terms of Service, Privacy Policy, Organizer Agreement and Acceptable Use Policy. Where a defined term appears with an initial capital in any of those documents, it has the meaning given here.

Nyvo, we, us, ourThe business name "Nyvo" under which Alick Ceglys Buscariolli (ABN 25 545 382 512) operates as a sole trader in New South Wales, Australia. Address for notices: NSW 2049, Australia. Email: hello@nyvo.com.au. References to "Nyvo" include the sole trader who carries on that business.
ServiceThe Nyvo platform, including the Nyvo mobile apps (iOS and Android), the Nyvo websites (including nyvo.com.au and organizer.nyvo.com.au), our APIs and any related features, content and communications.
User, youAny person who accesses or uses the Service, whether or not signed in.
AccountA registered user account on the Service, created and authenticated through Firebase Authentication.
CommunityA grouping seeded by Nyvo that pairs an origin country with a country of residence (for example, a country-of-origin nationality grouping within a country-of-residence). Communities are not created by Users.
OrganizerA User who lists a paid or free event on the Service, or who connects a Stripe Connect Express account to receive payment. The Organizer is the merchant of record for ticket sales they list.
BuyerA User who purchases a Ticket through the Service.
EventAn event listing created by an Organizer on the Service.
TicketAn entitlement issued to a Buyer to attend an Event, evidenced by a QR code signed by Nyvo.
Platform FeeThe fee Nyvo charges per Ticket sold through the Service. As at the date of these documents, this is 4.5% + A$0.50 per Ticket, added to the displayed Ticket price (pass‑to‑buyer). The current value of the Platform Fee is published in‑app and in the Organizer Agreement.
ContentAny material a User posts, uploads, submits, links, transmits or otherwise makes available through the Service, including posts, comments, images, polls, event descriptions, business or housing listings, and reports.
Reported ContentContent that has been the subject of a report under our Acceptable Use Policy or applicable law.
Personal InformationHas the meaning given in section 6 of the Privacy Act 1988 (Cth) (the Privacy Act). For users in Brazil, it has the equivalent meaning of dado pessoal under Lei nº 13.709/2018 (the LGPD).
APPAn Australian Privacy Principle set out in Schedule 1 of the Privacy Act.
ACLThe Australian Consumer Law, as set out in Schedule 2 of the Competition and Consumer Act 2010 (Cth).
StripeStripe Payments Australia Pty Ltd or its affiliates, our payment processor.
Stripe Connect ExpressThe Stripe product through which Organizers onboard, provide identity information to Stripe and receive payouts.
DocumentsTogether: the Terms of Service, Privacy Policy, Organizer Agreement and Acceptable Use Policy.

Language and precedence

These Documents are published in English (Australian English, en-AU) and in Brazilian Portuguese (pt-BR). The English version is the controlling text. Where there is any conflict or ambiguity between the two language versions, the English version prevails, except where applicable law (including the LGPD for Users resident in Brazil) requires otherwise.

Updates

We may update these Definitions when we add, change or remove material concepts elsewhere in the Documents. We will revise the version and last_updated fields above and note material changes in the change log of the affected Document.
